“When the Painter is Inspired by the Photographer: The Boundaries between Creation and Reproduction in Intellectual Property Law”

The courts were recently concerned with the following case: The painter A exhibited a series of paintings in the art gallery B, among which were paintings based on photographs by the photographer C. In the catalog of paintings, which had been edited by the gallery B, it was stated that A had been inspired by C’s photographs. After the end of the exhibition, C filed a lawsuit seeking compensation against A and B, invoking the provisions of Law 2121/1993. The legal validity of the aforementioned lawsuit was questioned.
